A man has been sentenced to serve a minimum of 120 years in federal prison after being convicted of selling counterfeit or expired medication, including Viagra.
According to the U. S. Attorney’s Office, Brian McBryack, 45, of Fort Myers, Florida, was convicted by a federal judge on November 14, 2010. He pleaded guilty to the conspiracy charge and the trafficking in counterfeit or expired medication, the Food and Drug Administration (FDA) Office of Criminal Investigations said.
The case was brought after the Food and Drug Administration (FDA) Office of Criminal Investigations received the results of an investigation into counterfeit medications from online retailers, including Walmart and CVS.
McBryack was arrested by U. Immigration and Customs Enforcement (ICE) agents in February 2011 while he was working as a pharmacist at Walmart in Fort Myers.

The medication was found to contain active ingredients found in Pfizer Inc’s own trademark, Viagra, which the FDA has warned the company about to consumers. The counterfeit Viagra was sold online by McBryack in the United States and the counterfeit medicine was sold in the United Kingdom, the U. K. and Mexico, the indictment said. McBryack, who has been charged with and is accused of selling counterfeit or expired medication, is currently in custody pending a federal criminal investigation.
He faces up to 10 years in federal prison and a $10 million fine. The FDA has warned about the dangers of counterfeit medication.
In a statement, the U. Attorney’s Office said, “This case illustrates that a strong public interest justifies a sentence that is far too lenient to receive. These convicted individuals face significant consequences when they face their roles as consumers, and our federal prosecution is paramount.
“We will pursue their complaints and bring them to justice, as we do our utmost in holding our country accountable for the actions they took.”
The FDA is currently investigating an investigation that began in December 2010 by the Food and Drug Administration (FDA) in its investigation of counterfeit medications.

The results came from a randomized, two-arm trial of sildenafil (Viagra®) and tadalafil (Cialis®), which is the only PDE5 inhibitor currently approved by the Food and Drug Administration (FDA).
The FDA approved sildenafil in 1998 and Cialis in 2006, and tadalafil and sildenafil are the two most prescribed PDE5 inhibitors in the United States. The drug has the same chemical structure as Viagra, Cialis and sildenafil, but a different mechanism of action.
The FDA approved sildenafil and Cialis in 2006 for the treatment of ED and ED associated with benign prostatic hyperplasia (BPH), a non-cancerous enlargement of the prostate. The Food and Drug Administration (FDA) approved sildenafil and Cialis in 2003, and tadalafil and sildenafil in 2008. In the trial, the patients were asked to rate their sexual desire on three separate occasions: one before intercourse; one after intercourse; and one after intercourse. The drug was originally tested in the late 1990s and has now been approved by the FDA in both males and females. The drug was also FDA-approved for treatment of erectile dysfunction (ED) in patients with PAH.
As part of the study, the FDA will conduct a separate study on the effectiveness of sildenafil and tadalafil in the treatment of BPH. The study is planned to enroll patients between the ages of 18 and 60.
The FDA also said that it is reviewing the FDA's decision to discontinue use of sildenafil and tadalafil in patients with BPH. The FDA will make recommendations for patients to take sildenafil and tadalafil as they are prescribed a PDE5 inhibitor.
